1. Acceptance of Terms

By accessing or using Adey Here ("the App," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the App. Adey Here is operated by Seth Whenton.

2. Description of Service

Adey Here is a location-based social application that allows users to create and join temporary, geofenced digital communities called "Spaces." Spaces are designed for events, meetups, and gatherings where users can interact with others who are physically nearby. Features include real-time chat, peer-to-peer interactions (waves, winks, high-fives), friend connections, announcements, Q&A boards, and Lost & Found boards.

3. Eligibility

You must be at least 13 years old to use Adey Here. By creating an account, you confirm that you meet this age requirement. If you are under 18, you represent that you have permission from a parent or legal guardian to use this service.

4. Account Registration

• You may sign in using Google OAuth, email/password, or anonymously.
• You are responsible for maintaining the security of your account.
• You must provide accurate information when creating your profile.
• You may not use offensive, vulgar, or impersonating display names.
• One account per person. Multiple accounts may be terminated.

5. Acceptable Use

You agree NOT to:

• Harass, bully, threaten, or intimidate other users
• Post offensive, hateful, sexually explicit, or illegal content
• Spam, solicit, or advertise without permission
• Impersonate another person or entity
• Use the App for illegal activities or to facilitate harm
• Attempt to exploit, hack, or disrupt the App's infrastructure
• Scrape, harvest, or collect user data without consent
• Share your account credentials with others
• Create Spaces for purposes that violate these terms

6. User-Generated Content

• You retain ownership of content you create (messages, posts, Lost & Found items).
• By posting content, you grant Adey Here a license to display it to other users in the relevant Space.
• Content in Spaces is ephemeral and may be deleted when a Space expires.
• We may remove content that violates these terms without notice.

7. Location Data

Adey Here requires access to your precise location to function. Location data is used to show your position on the map, enable geofencing for Spaces, and facilitate nearby interactions. By using the App, you consent to the collection and use of your location data as described in our Privacy Policy.

8. Hosting Spaces

• Any user may host a Space (duration: 30 minutes to 6 hours, radius: 5-50m).
• Hosts are responsible for the conduct of participants in their Space.
• Hosts may kick or ban users who violate these terms.
• Hosts may not use Spaces to organize illegal activities.
• We reserve the right to remove Spaces that violate our policies.

9. Moderation and Enforcement

We may take the following actions for violations of these terms:

• Remove or hide content
• Temporarily or permanently ban users
• Remove or restrict Spaces
• Report illegal activity to law enforcement

Users may also be subject to moderation actions by Space hosts, including being kicked or banned from individual Spaces.

10. Intellectual Property

Adey Here, including its design, code, branding, and logo, is owned by Seth Whenton and protected by copyright and intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our written permission.

11. Disclaimers

• The App is provided "AS IS" without warranties of any kind.
• We do not guarantee the App will be error-free, secure, or available at all times.
• We are not responsible for user conduct or interactions between users.
• We do not verify the identity of users. Use caution when meeting people in person.
• We are not liable for any harm resulting from your use of the App.

12. Limitation of Liability

To the maximum extent permitted by law, Adey Here and its operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of profits, or personal injury arising from your use of the App.

13. Indemnification

You agree to indemnify and hold harmless Adey Here, its operator, and affiliates from any claims, damages, or expenses arising from your use of the App, your content, or your violation of these terms.

14. Changes to Terms

We may update these Terms of Service from time to time. We will notify users of material changes by posting the updated terms on this page. Continued use of the App after changes constitutes acceptance of the new terms.

15. Termination

You may stop using the App at any time and request deletion of your account. We reserve the right to suspend or terminate accounts that violate these terms, with or without notice.

16. Governing Law

These terms are governed by the laws applicable in your jurisdiction. Any disputes arising from these terms shall be resolved through good-faith negotiation or, if necessary, through the courts of competent jurisdiction.
